CAPT. JAMES BURGESS (1802-1847) OF HARRISON COUNTY, KENTUCKY
James (III) "Capt." [son of John (I)]. Born about 1802 in Fauquier Co., VA. Married Anice "Ann" Webber on 18 Sept. 1821 in Harrison Co. (she was the daughter of Sarah [and William?] Anderson, and died 1834; by her first marriage to Webber, she had children: William Anderson); married secondly Mary Hings(t)on on 17 Aug. 1837 in Harrison Co. (she was born 1810 in DE, and died by 2 Oct. 1865, when her share of her husband's estate is apportioned among her children). Listed in the 1830-40 censuses and 1823-46 tax records for Hanison Co., KY; Mary is listed in 1850 with Leonard Barker, and in the tax records as guardian for William and Mary through 1864. After her death, her children deeded their share of her widow's dower to the Scotts (Deed Book #30, p. 448, 2 Oct. 1865). A Harrison Co. lawsuit names James as a brother of John Burgess (Lail vs. Burgess, Case #6065, 8 June 1832). His military service is unknown. A farmer in the Rutland Precinct of Harrison Co., Capt. James Burgess died intestate by 8 Mar. 1847, when he is mentioned as deceased in a Harrison Co. guardian record. His children are proven through subsequent probate divisions (Record Book #F, p. 483); Charles and Cynthiana were placed under the guardianship of John Burgess Jr., and William and Mary under their mother.
